Terms of Service — Bird Identifier

By downloading or using Bird Identifier ("the app"), you agree to these terms. If you don't agree, please don't use the app.

1. What the app does

The app identifies birds from a photo or from a recording of their song, and shows birding hotspots and species information. Identifications are generated automatically and may be wrong. They are provided for information and education only.

2. Not professional or safety advice

Species names, notes and facts are informational. Most wild birds should not be handled, and some (raptors, herons, swans, seabirds) can injure — do not approach or handle a wild bird based on an app result. If you find an injured or orphaned bird, contact a licensed wildlife rehabilitator or local wildlife authority. The app is not a substitute for professional ornithological, medical or veterinary advice.

3. Subscriptions

Premium features (unlimited identifications, detailed species profiles and look-alike comparisons) require a subscription billed through your Apple account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in Settings → your name → Subscriptions. Refunds are handled by Apple under their terms. Where required, Apple's standard licensed application terms apply: Apple Standard EULA.

4. Acceptable use

You agree not to abuse the service — including automated scraping, reverse-engineering the app or its API, circumventing usage limits or subscription checks, or using the app for anything unlawful.

5. Third-party services

The app relies on third-party services: AI photo processing (OpenAI), on-device sound recognition using BirdNET by the Cornell Lab of Ornithology, birding hotspot and sighting data from eBird (Cornell Lab), subscription management (RevenueCat) and payments (Apple). Their availability is outside our control; features may be limited if a provider is unavailable.

6. No warranty, limitation of liability

The app is provided "as is", without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for losses or harm arising from decisions made based on identifications or other information in the app. Our total liability is limited to the amount you paid for the app in the last 12 months.

7. Changes and termination

We may update the app, these terms, or discontinue the service. Material changes to these terms will be reflected by the effective date above. We may suspend access in cases of abuse (section 4).
